Overview
This Acceptable Use Policy ("AUP") defines the rules and guidelines for using the Fixty platform and all associated services (collectively, the "Platform"). It is designed to protect the integrity of our services, safeguard our users, and ensure a professional experience for everyone.
This AUP applies to all users of the Platform, including mechanics, their staff, and any person who accesses the Platform through a mechanic's account. By using the Platform, you agree to comply with this policy. Violation of this AUP may result in suspension or termination of your account.
Prohibited Activities
The following activities are strictly prohibited when using the Fixty platform.
Spam and Unsolicited Messages
You may not use the Platform's SMS capabilities (powered by Twilio) to send spam, unsolicited bulk messages, or marketing communications to individuals who have not consented to receive them. All messages sent through the Platform must relate to legitimate business interactions between a mechanic and their customers, such as appointment confirmations, quote approvals, job updates, and invoice notifications.
Illegal Services or Activities
You may not use the Platform to facilitate, promote, or conduct any illegal activities. This includes advertising or performing unlicensed automotive services where licensure is required, engaging in fraudulent billing practices, or using the Platform in connection with any business activity that violates applicable federal, state, or local laws.
Data Scraping and Harvesting
You may not use automated tools, bots, scrapers, or any other means to extract, harvest, or collect data from the Platform. This includes customer information, pricing data, business listings, or any other content accessible through the Platform.
Impersonation
You may not impersonate any person or entity, or falsely state or misrepresent your identity, qualifications, or affiliation with any person or organization when using the Platform. This includes creating accounts under false identities or misrepresenting your business credentials.
Malware and Harmful Code
You may not upload, transmit, or distribute any viruses, malware, trojans, ransomware, spyware, or any other harmful code through the Platform. This includes attaching malicious files to quotes, invoices, or any other documents generated through the Platform.
Circumventing Security Measures
You may not attempt to bypass, disable, or circumvent any security features of the Platform, including authentication mechanisms, row-level security policies, rate limiting, or access controls. You may not probe, scan, or test the vulnerability of the Platform without prior written authorization from Fixty.
Reverse Engineering
You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform or any part thereof. You may not create derivative works based on the Platform or any of its components.
Excessive API Usage
You may not make API requests at a rate or volume that degrades the Platform's performance for other users. Fixty reserves the right to implement and enforce rate limits. If your usage pattern significantly exceeds normal operational needs, we may contact you to discuss your usage or temporarily restrict access to protect platform stability.
Account Responsibility
Each Fixty account is intended for use by a single independent mechanic or a single business entity. Sharing account credentials with unauthorized individuals is prohibited. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must immediately notify Fixty at security@fixty.com if you become aware of any unauthorized use of your account or any other breach of security. Fixty is not liable for any loss or damage arising from your failure to protect your account credentials.
You are solely responsible for all content you create, data you enter, and communications you send through the Platform, including customer records, quotes, invoices, and SMS messages.
Content Standards
All content created or transmitted through the Platform, including customer-facing quotes, invoices, appointment confirmations, and SMS messages, must comply with the following standards.
Content must not be obscene, threatening, harassing, discriminatory, defamatory, or otherwise offensive. Content must not infringe upon the intellectual property rights of any third party. Content must not contain false or misleading information about your business, services, qualifications, or pricing.
You must ensure that your business information, including your business name, contact details, and service descriptions, is accurate and up to date. Misrepresenting your business to customers through the Platform is a violation of this policy.
Reporting Violations
If you become aware of any violation of this Acceptable Use Policy, we encourage you to report it promptly. Reports help us maintain a safe and professional environment for all users.
To report a violation, please email abuse@fixty.com with a detailed description of the activity, including any relevant account information, dates, and supporting evidence. All reports are reviewed by our team and treated confidentially to the extent permitted by law.
Enforcement
Fixty enforces this policy using a graduated response approach based on the severity of the violation.
For first-time or minor violations, we will issue a written warning and request that you cease the prohibited activity. If the violation continues or if additional violations occur, Fixty may temporarily suspend your account and restrict access to the Platform. For repeated or severe violations, Fixty may permanently terminate your account and delete your data in accordance with our data retention policies.
Fixty reserves the right to act immediately, without prior warning, in cases of severe violations that pose a risk to the security of the Platform, the safety of other users, or the integrity of our services. Such severe violations include distributing malware, engaging in illegal activities, or attempting to compromise Platform security.
Fixty will make reasonable efforts to notify you of any enforcement action taken against your account and provide an opportunity to address the issue, except where immediate action is required to protect the Platform or its users.
Changes to This Policy
Fixty reserves the right to modify this Acceptable Use Policy at any time. We will provide at least 30 days' advance notice of any material changes by sending a notification to the email address associated with your account and by posting the updated policy on our website.
Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised policy. If you do not agree with the updated terms, you should discontinue your use of the Platform before the changes take effect.
